ARTICLE XIII RULES AND REGULATIONS OF THE EMERGENCY SICK LEAVE BANK

A. The NEANK can operate an Emergency Sick Leave Bank.

1. The intent of the Bank is to provide additional financial protection for those teachers who have exhausted all but 5 (five) days of their accumulated sick leave and who incur a period of serious personal illness, accident or hospitalization, as verified in writing by a physician according to Article XII A.4a. Serious illness is defined to mean a disabling physical or mental illness, injury, impairment or condition that involves in-patient care in a hospital, nursing home, or hospice, or out-patient care requiring continuous treatment by a member's primary care physician or a licensed medical specialist specific to that illness or injury. Sick bank can only be awarded to an employee of the District for the aforementioned conditions and other requirements of this article. Sick bank cannot be awarded for maternity leave or an extension thereof. The Sick Leave Bank shall be applicable only to teacher (not family) illness or accident.

2. Sick bank can only be used for an illness lasting five (5) or more consecutive days. Sick bank is not for daily or hourly usage.

B. The NEANK will inform the School Department of the names of the members and the number of days to be deducted from the members' sick time and contributed to the Sick Bank. No member may donate days that they would have lost because the member had maximized their 130 days. NEANK will provide detailed records to Administration on January 1 and July 1, that show balance of days remaining in the sick bank as well as actual usage.

C. The NEANK will inform the School Department when a member is accessing the sick bank, how many days the member has been granted, and the member's expected date of return to work. Members who have been granted days from the sick bank will communicate every two weeks with their building principal and Human Resources about anything that might impact the length of time they will be out, or that might change their expected date of return to work.

D. The School Department will provide salary payments for sick leave granted from the sick bank for one-hundred percent (100%) of regular pay (including compensation for advanced degrees, service as department chairperson, longevity) in accordance with the provisions of this article. The department chairperson stipend will transfer to another teacher when they assumes the duties of the department chairperson. If Sick Bank requests are not submitted and approved within a pay period, salary adjustments will be processed in the next scheduled pay period.

E. When requested, the School Department will supply the NEANK with attendance information about applicants to the sick bank, within 5 working days.

F. Days contributed to the Sick Bank will not expire.

G. The decisions of the Sick Bank are final.
